As a content provider according to the Telemedia Act (TMG) and the State Treaty on Broadcasting (RStV), ARCOMM GmbH is responsible for the 'own content' that ARCOMM GmbH makes available for use in accordance with general laws.
A distinction must be made between this own content and cross-references ('links') to content provided by other providers. Through the cross-reference, ARCOMM GmbH keeps " third-party content " ready for use. ARCOMM GmbH is only responsible for this third-party content if ARCOMM GmbH has positive knowledge of it (i.e. also of illegal or criminal content) and it is technically possible and reasonable for ARCOMM GmbH to prevent its use.
"Links" are always " living " (dynamic) references. When the link was first established, ARCOMM GmbH checked the third-party content to determine whether it might trigger civil or criminal liability.
